2. Collection and storage of personal data and the nature and purpose of its use

a) When visiting the website

When you access our website oberbillwerder-hamburg.de, your browser automatically sends information to our website’s server. This information is temporarily stored in a log file. The following information is collected automatically and stored until it is automatically deleted:

For the technical processing of the newsletter, your email address will be passed on to the technical service provider CleverReach GmbH & Co. KG, Mühlenstr. 43, 26180 Rastede, Germany and stored there.

You can unsubscribe at any time, for example via a link at the end of each newsletter. Alternatively, you can send your unsubscribe request to oberbillwerder@iba-hamburg.de at any time. Your address will be deleted from Cleverreach upon unsubscription.

c) Whe using our contact form

If you have any questions, you can contact us using the form provided on our website. We store and process this data in accordance with Article 6 Paragraph 1 Sentence 1 Letter a of the GDPR based on your freely given consent in order to process your request.

3. Data transfer

We only share your personal data with third parties if:

  • You have given your explicit consent in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR,
  • the transfer is necessary pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR for the establishment, exercise or defense of legal claims and there is no reason to assume that you have an overriding legitimate interest in not having your data transferred,
  • in the event that there is a legal obligation to disclose the data pursuant to Article 6(1)(c) GDPR, as well as
  • This is legally permissible and necessary for the performance of a contract with you in accordance with Article 6(1)(b) GDPR.

Please note that in certain situations, it may be necessary to disclose personal data in legal proceedings or to authorities. Your personal data will not be transferred to third parties for any purposes other than those listed.

4. Cookies

Provided you have given your consent, this website uses Matomo (formerly Piwik), an open-source software for the statistical analysis of visitor access. The provider of the Matomo software is InnoCraft Ltd., 150 Willis St, 6011 Wellington, New Zealand.

The statistical data is transferred to and stored on a server of the company Kaller & Kaller Werbeagentur, Kottbusser Damm 70, 10967 Berlin.

Matomo places a cookie (a text file) on your device, which allows your browser to be recognized. When subpages of our website are accessed, the following information is stored:

  • The user’s IP address, shortened by the last two bytes (anonymized)
  • the accessed subpage and the time of the access
  • the page from which the user accessed our website (referrer)
  • which browser with which plugins, which operating system and which screen resolution is used
  • the time spent on the website
  • the pages that are accessed from the requested subpage

We use Matomo to improve the quality of our website and its content. This allows us to understand how the website is used and to continuously optimize our offerings.

By anonymizing the IP address by removing six digits, we respect the website visitor’s interest in protecting their personal data. You have the right:

  • In accordance with Article 15 of the GDPR, you have the right to request information about your personal data processed by us. In particular, you can request information about the purposes of the processing, the categories of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the origin of your data if they were not collected by us, and the existence of automated decision-making, including profiling, and, where applicable, meaningful information about the logic involved.
  • In accordance with Article 16 GDPR, you have the right to request the immediate rectification of inaccurate or incomplete personal data concerning you that we hold;
  • In accordance with Article 17 GDPR, you have the right to request the erasure of your personal data stored by us, unless processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defense of legal claims;
  • In accordance with Article 18 GDPR, you have the right to request the restriction of the processing of your personal data if you contest the accuracy of the data, the processing is unlawful but you oppose its erasure, we no longer need the data but you require it for the establishment, exercise or defense of legal claims, or you have objected to processing pursuant to Article 21 GDPR;
  • In accordance with Article 20 GDPR, you have the right to receive the personal data you have provided to us in a structured, commonly used and machine-readable format or to request its transmission to another controller;
  • In accordance with Article 7(3) of the GDPR, you have the right to withdraw your consent at any time. This means that we will no longer be permitted to process your data based on this consent in the future.

8. Right to object

If your personal data is processed based on legitimate interests pursuant to Article 6(1)(f) GDPR, you have the right to object to the processing of your personal data pursuant to Article 21 GDPR, provided there are grounds relating to your particular situation or the objection is directed against direct marketing. In the latter case, you have a general right to object, which we will implement without requiring you to specify a particular situation.
